Stephen Casey

Stephen’s principal areas of practice have been insurance litigation including property damage claims, life, health, disability claims, coverage issues and real estate disputes plus professional malpractice and employment law with a specific emphasis on personal injury claims. Stephen has extensive trial advocacy in Provincial, Supreme and Appellate levels of court in British Columbia. Stephen has acted for and against both public and private insurance companies.

Stephen graduated with a Bachelor of Arts Degree from the University of Manitoba in 1981 and obtained a law degree from the University of British Columbia in 1986. He practiced in downtown Vancouver until 1994 and since then in Victoria.  Stephen is a member of the Law Society of British Columbia, Canadian Bar Association, Victoria Bar Association and a past long time member of the Trial Lawyers Association of British Columbia. He is an avid golfer, skier, cyclist, swimmer and tennis player.

In the late 1980’s and early 1990’s Stephen was counsel for the Law Society of British Columbia and reported to the secretary of the Law Society and the Director of Insurance.  At the same time, Stephen was counsel for the Public Guardian and Trustee of the Province of British Columbia with respect to subrogated personal injury claims for elderly, infants and  incapacitated wards of the Public Trustee.

In the early 1990’s Stephen was in-house defence counsel and claims examiner with the Real Estate Errors & Omissions Insurance Corporation in British Columbia. During that time he was involved in hundreds of real estate litigation actions on behalf of real estate sales persons and agencies throughout the entire province concerning allegations of negligence, breach of contract, fraud, breach of fiduciary duty which also included various building construction issues.

Stephen has extensive experience in conducti ng mediations, conventional trials, jury trials, fast track trials and numerous court applications. He has utilized various medical experts including general engineers, structural engineers, architects and appraisers in regards to real property disputes, personal injury and fire loss claims.

Over the past 30 years Stephen has participated in excess of approximately 2000 personal injury claims and actions involving motorized vehicles. He has also been involved in numerous cases involving occupier’s liability with personal injury and property damage. These cases have included public transportation carriers, BC Ferries, school premises, public areas and commercial establishments.

Stephen has extensive advocacy experience before various administrative tribunals including the Human Rights Tribunal, Worksafe, CPP, Employment Standards Branch and labour/employment arbitrations.

In the past, Stephen has prepared written papers and presentations pertaining to: How to Prepare Disclosure Statements under the Real Estate Act, The Avoidance of a Negligent Misrepresentation Law Suit, Responding to Complaints Made to the Real Estate Council of British Columbia and Drafting a Legally Enforceable Contract of Purchase and Sale.

Stephen was a board member of the Westmont Montessori School Society and for many years was the president of a 20-Property Strata Corporation.

Currently Stephen acts for hundreds of individuals and businesses in civil disputes.
